1. Introduction

Welcome to Green Ride Rentals ("we", "us", "our"). These Terms and Conditions govern your use of our car rental and accident replacement vehicle services provided by Green Ride Rentals (ACN 672 925 218), located at 77 Latrobe Rd, Morwell VIC 3840, Australia.

By booking a vehicle, completing a rental agreement, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree, you must not proceed with any booking or rental.

2. Definitions

"Renter" or "You" refers to the individual or entity entering into a rental agreement with Green Ride Rentals.

"Vehicle" refers to any motor vehicle provided by Green Ride Rentals for use under a rental agreement.

"Rental Period" refers to the duration agreed upon in the rental agreement during which you are authorised to use the vehicle.

"Accident Replacement Vehicle" refers to a vehicle provided under our not-at-fault accident replacement program.

"Insurer" refers to any insurance company involved in the resolution of an accident claim.

3. Eligibility

To rent a vehicle from Green Ride Rentals, you must:

• Be at least 21 years of age, additional age conditions may apply for certain vehicle categories.
• Hold a valid full Australian driver's licence, or a valid international driver's licence if visiting from overseas.
• Not have any major driving convictions or be subject to a licence suspension within the past three years.
• Provide acceptable photo identification.
• Have a valid credit or debit card in your name for bond purposes.

We reserve the right to refuse a rental to any person who does not meet these criteria or who we, in our reasonable discretion, deem unsuitable.

4. Rental Agreement

All vehicle rentals are subject to a separate Rental Agreement signed at the time of vehicle collection. The Rental Agreement will set out the specific terms applicable to your booking, including vehicle details, rental period, rates, and any special conditions.

The Rental Agreement forms part of these Terms and Conditions. In the event of any inconsistency between the two documents, the Rental Agreement will take precedence for the specific transaction to which it relates.

5. Payment and Fees

Rental fees are payable in advance unless otherwise agreed in writing. Accepted payment methods include major credit and debit cards. Personal cheques are not accepted.

A security bond will be pre-authorised on your credit or debit card at the time of vehicle collection. This bond is released upon return of the vehicle in satisfactory condition within the agreed rental period. The bond amount varies depending on the vehicle class and will be communicated to you at booking.

Additional charges may apply for:

• Late return of the vehicle beyond the agreed rental period
• Fuel: vehicles must be returned with the same fuel level as at collection
• Excessive cleaning requirements
• Toll charges incurred during the rental period
• Traffic or parking infringements issued during the rental
• Loss or damage to keys, accessories, or vehicle parts

6. Insurance

All vehicles in our fleet carry compulsory third-party (CTP) insurance as required under Victorian law. Additional vehicle damage cover options may be available and will be communicated at the time of booking.

You are responsible for any damage to the vehicle during the rental period not covered by the insurance product selected. You are strongly encouraged to review any excess amounts and cover options before signing the Rental Agreement.

For accident replacement vehicle customers: the cost of the replacement vehicle, in not-at-fault circumstances, is pursued through the at-fault party's insurer. You acknowledge that approval from that insurer is not guaranteed and that Green Ride Rentals cannot accept responsibility for an insurer's decision.

7. Authorised Vehicle Use

You agree that the vehicle will only be driven by the named renter and any additional authorised drivers named in the Rental Agreement. The vehicle must not be:

• Used for hire, reward, or any commercial purpose, unless specifically agreed in writing
• Driven under the influence of alcohol or any drugs or substances that impair driving
• Used in any motorsport event, race, or off-road activity
• Driven outside of the state of Victoria without prior written approval
• Used to tow any trailer or other vehicle unless expressly authorised
• Operated in breach of any road traffic laws

Any breach of these conditions may void your insurance cover and render you fully liable for damages.

8. Damage and Liability

You must report any damage to the vehicle — however minor — to us immediately. Failure to report damage may result in you being held liable for any costs that arise as a consequence of the unreported damage.

In the event of an accident, you must:

• Contact emergency services if required
• Not admit liability to any third party
• Collect the name, licence, vehicle registration, and insurer details of all parties involved
• Contact Green Ride Rentals as soon as practicable to report the incident
• Complete an incident report form as provided by us

9. Accident Replacement Vehicle Service

Our accident replacement vehicle service is designed to assist not-at-fault drivers in obtaining a comparable vehicle while their own vehicle is being repaired or assessed. The following conditions apply:

• Eligibility is subject to our assessment of the accident circumstances and the other party's acceptance of liability.
• We will make reasonable efforts to pursue reimbursement from the at-fault party's insurer. However, we do not guarantee recovery of all costs.
• The replacement vehicle will be of a reasonably similar class to your own vehicle, subject to availability.
• You remain responsible for any use of the replacement vehicle in breach of these Terms.
• The service will conclude upon return of your own repaired vehicle, or upon instruction from the relevant insurer, whichever comes first.

10. Cancellation

Cancellations made with more than 24 hours' notice prior to the scheduled vehicle collection time will receive a full refund of any prepaid amounts. Cancellations made within 24 hours may incur a cancellation fee. Please refer to our Refund Policy for full details.

Green Ride Rentals reserves the right to cancel a booking in exceptional circumstances, including but not limited to vehicle unavailability due to accident or breakdown. In such cases, a full refund will be provided.

11. Early Termination

We reserve the right to terminate the rental agreement immediately and require the vehicle's return if:

• The vehicle is used in breach of these Terms and Conditions
• Payment is not made as agreed
• The renter's licence is suspended or cancelled during the rental period
• The vehicle is endangered, misused, or abandoned

12. Disputes and Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. In the event of a dispute, both parties agree to first attempt to resolve the matter through direct negotiation in good faith.

If a resolution cannot be reached, the matter may be referred to Consumer Affairs Victoria or a relevant dispute resolution body. You retain any rights available to you under applicable Australian consumer law, including the Australian Consumer Law (ACL).

13. Changes to These Terms

Green Ride Rentals may update these Terms and Conditions from time to time. The most current version will always be available on our website. Your continued use of our services after any changes constitutes acceptance of the updated terms.
